Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Field Forge AI website, software, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity.

1. Services

Field Forge AI provides software to help home-service and field-service businesses manage customer intake, communications, appointments, scheduling, dispatch, jobs, customer records, quotes, invoices, payments, billing, reporting, and related operational workflows.

2. Accounts and acceptable use

• You must provide accurate information when creating or maintaining an account.
• You are responsible for safeguarding account credentials and for all activity occurring under your account.
• You may not use the Services for unlawful, fraudulent, abusive, infringing, or harmful purposes.
• You may not interfere with the integrity, performance, or security of the Services.

3. Customer data

As between the parties, you or your organization retain rights to the business and customer data you submit to the Services (“Customer Data”), subject to the rights we need to provide, maintain, and support the Services. You are responsible for the legality, accuracy, and quality of Customer Data and for obtaining any rights, notices, or consents needed to use that data within the Services.

4. Messaging, calling, and consent obligations

The Services may support email, SMS, and other communications features. You are solely responsible for ensuring that your use of those features complies with applicable law, carrier requirements, and industry rules, including any consent, notice, opt-out, recordkeeping, and content requirements.

• Field Forge AI messaging is intended primarily for transactional and operational communications such as appointment confirmations, reminders, dispatch updates, service notifications, invoice notices, and customer support.
• You must obtain any consent required before sending SMS or similar communications to recipients.
• Recipients may be offered standard opt-out instructions such as replying STOP and support instructions such as replying HELP, where supported.
• Message frequency varies by customer activity. Message and data rates may apply.
• You may not use the Services to send unlawful spam, misleading content, or prohibited marketing communications.

5. Fees and billing

Paid subscriptions, usage-based charges, or custom commercial terms may apply depending on your selected plan or agreement. Unless otherwise stated, fees are non-refundable except as required by law. You authorize us and our payment processors to charge applicable fees, taxes, and related amounts.

6. Availability and changes

We may update, improve, modify, suspend, or discontinue all or part of the Services from time to time. We do not guarantee that every feature will be available at all times or in all regions.

7. Intellectual property

The Services, including software, content, design, branding, and related materials, are owned by Field Forge AI or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your internal business purposes.

8. Third-party services

The Services may interoperate with third-party providers such as payment processors, email providers, SMS providers, analytics services, or other integrations. We are not responsible for third-party services, and your use of them may be subject to their separate terms and privacy policies.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD FORGE AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THEY WILL MEET EVERY BUSINESS REQUIREMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD FORGE AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FIELD FORGE AI FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO FIELD FORGE AI FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

We may suspend or terminate access to the Services if you violate these Terms, create risk or harm, fail to pay fees when due, or if continued access is no longer commercially or legally feasible. You may stop using the Services at any time, subject to any subscription or contract commitments.

12. Governing law

These Terms are governed by the laws of the applicable state or jurisdiction designated in your final production legal documents, without regard to conflict-of-law rules. Replace this section with Field Forge AI’s final governing-law and venue choices before publishing.
